Terms and Conditions
Last updated: May 13, 2026
These terms govern Hermes's public marketing site and pre-signup service conversations only. Official operating terms for provisioned stores and signed customers are provided separately during signup or contracting.
1. Scope of These Terms
These Terms and Conditions apply to your use of the Hermes landing site, any request-access, contact, pricing, demo, onboarding, or sales inquiry you submit through it, and our pre-signup discussions about e-commerce site provisioning services. Separate terms, store policies, billing terms, and platform agreements may apply after signup, contracting, or launch.
2. Eligibility and Authority
You represent that you may lawfully use this site and, if you are acting for a company or merchant, that you have authority to submit information and request services on that business's behalf. You agree to provide accurate, current, and complete information in any form or email you send to us.
3. Service Information, Quotes, and Pricing
Any descriptions of packages, features, provisioning timelines, integrations, launch support, or pricing on this site are for general information only unless we confirm them in a written proposal, order form, or service agreement. Final scope, timing, deliverables, and fees may change based on your requirements, third-party dependencies, technical discovery, or implementation complexity.
4. Customer Responsibilities
You are responsible for supplying timely approvals, lawful content, accurate business information, and any assets, credentials, catalog details, payment information, tax settings, or integration access reasonably needed for us to evaluate or provision a store. Delays or inaccuracies may affect scope, pricing, timelines, or service availability.
5. Acceptable Use
You may not use this site or our contact channels to submit unlawful, infringing, deceptive, abusive, malicious, or fraudulent material; interfere with the site's operation; attempt unauthorized access; or misrepresent your identity, business, or intended use of our services. We may decline or suspend responses to requests that create legal, compliance, fraud, or security concerns.
6. Third-Party Services
Our provisioning services may involve third-party platforms and vendors, including hosting providers, domain registrars, e-commerce software, payment processors, analytics providers, and email tools. Their availability, fees, policies, service levels, and limitations are outside our reasonable control and may be governed by separate third-party terms.
7. Intellectual Property
The Hermes landing site and its content remain our property or the property of our licensors unless otherwise stated. Any storefront, code, content, configuration, or deliverables provided after signup or contracting will be governed by the specific commercial terms agreed at that stage.
8. Email and Contact Consent
By submitting a form, requesting pricing, or contacting us through this site, you agree that Hermes Digital LLC may contact you by email or other contact details you provide in order to respond to your inquiry, evaluate fit, discuss pricing, schedule onboarding, or provide requested service information. You may request that we stop non-essential outreach at any time.
9. Disclaimers and Limitation of Liability
This site and all pre-signup information are provided "as is" and "as available" without warranties of any kind except as required by law. To the fullest extent permitted by law, Hermes Digital LLC disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost revenue, profits, data, goodwill, or business opportunities arising from your use of this site or reliance on pre-signup materials.
10. Changes to These Terms
We may update these Terms and Conditions from time to time by posting a revised version on this page. Your continued use of the site after changes become effective constitutes acceptance of the updated terms.
11. Separate Operational Terms
These Terms and Conditions do not replace the official terms, store policies, service schedules, or merchant obligations that will apply once a user signs up or a site is provisioned. Those operational terms will be presented separately in the relevant product, contract, or onboarding flow.
